Acceptance of terms

By creating a Magikx account you agree to these Terms. If you don’t agree, don’t use the service.

The service

Magikx is a Marketing OS that creates, schedules, and publishes social media content, manages engagement, and provides marketing insights, using AI. Features vary by plan.

Your account

• You must provide accurate information and keep your login secure.
• You are responsible for activity on your account, including content published through connected social accounts.

Connecting social accounts

• When you connect a social media account, you authorise Magikx to access and act on it via OAuth (through our provider, Zernio) for the purposes you configure — e.g. publishing posts, scheduling, or replying to comments.
• By default, replies are drafted for your approval and nothing is sent without it. Your workspace has an automation level that controls this. Normally it rises gradually with use, as you approve drafts, so that progressively more routine replies — starting with responses to positive comments — are sent without a manual check. You may also raise the level yourself in your workspace settings, up to full automation, without waiting for that gradual increase. You can lower it again at any time.
• Scheduled posts are published automatically. Once a post is scheduled and the relevant channel is connected, it goes live at its scheduled time without a further review step. Magikx recommends a schedule for each post, which you can change at any time before publication.
• So content can reach your audience without your manual review at the point it goes out — through scheduled publishing, and through automated replying at any automation level above the default. You are responsible for your schedule, your automation level, and your automation settings, and for understanding what will be published or sent without a manual check.
• You can revoke access to any connected account at any time from your workspace settings.

AI-generated content

• Content drafted by Magikx’s AI is provided as a starting point. You are responsible for reviewing it before it is published. Because scheduled posts publish automatically, that review needs to happen before the scheduled time — not after.
• Magikx is not liable for the consequences of content you choose to schedule and publish, including AI-drafted content you did not review.

AI Agents Disclaimer

Our AI agents are automated software systems that operate based on algorithms and data analysis. They are not human marketing professionals. While they are designed to assist with marketing optimisation, they are tools intended to work under your supervision and may:

• Recommend decisions that do not produce the desired outcome
• Respond to data signals in ways that are unexpected or suboptimal
• Take actions that, with the benefit of hindsight, were not the best course of action
• Experience delays, errors, or interruptions due to technical issues
• Misinterpret data, apply incorrect optimisation logic, or fail to identify issues that a human expert would recognise
• Take actions that inadvertently increase your marketing costs or reduce marketing effectiveness

You acknowledge and agree that our AI agents are automated tools designed to assist with marketing management under your active supervision. They are not a replacement for qualified marketing expertise.

Billing

• Free tier: free for 6 weeks, after which your workspace converts to a paid plan.
• Paid plans: billed per seat, monthly or annually — see pricing for current rates.
• You can cancel at any time; cancellation takes effect at the end of the current billing period.

Acceptable use

You may not use Magikx to create or publish illegal, hateful, or deliberately misleading content, or to spam or harass others. We can suspend accounts that breach this.

Intellectual property

You own the content you create and the content Magikx generates for you. You grant Magikx a licence to process that content solely to provide the service.

Third-party services

Magikx relies on third parties (including social media platforms and Zernio) to function. We’re not responsible for outages, policy changes, or account actions taken by those third parties that are outside our control.

Limitation of liability

To the maximum extent permitted by law, our total aggregate liability to you for any and all claims arising from or related to the use of Magikx, whether in contract, tort (including negligence), strict liability, or otherwise, is limited to the total amount you have paid to us in the three (3) months immediately preceding the event giving rise to the claim.

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, regardless of whether we have been advised of the possibility of such damages. You accept full responsibility for your social, advertising accounts and the outcomes of content managed through Magikx. It is your responsibility to monitor activity via Magikx and to override or disconnect at any time if you are not satisfied with the actions being taken.

Termination

Either party can terminate. We may suspend or terminate accounts that breach these Terms or the acceptable use rules above.

Governing law

These Terms are governed by the law of England and Wales.

Changes to these Terms

We may update these Terms from time to time. We’ll notify you of material changes.
